1. Beta Status & Acceptance

Tomb of the Infinite ("the Game") is currently in closed beta testing. By creating an account, you ("the Player") agree to these Terms of Service and the Beta Confidentiality Agreement contained herein (collectively, "the Terms"). If you do not agree, do not create an account or access the Game.

The Game is operated by the Tomb of the Infinite development team ("we," "us," or "our"). These Terms constitute a legally binding agreement between you and us.

2. Invitation-Only Access

Access to the Game during the beta period is by invitation only. Each invitation is personal and non-transferable. You may not share, sell, or distribute your invitation or account access to any third party.

We reserve the right to revoke access at any time, for any reason, without notice.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate information during registration
  • Not share your account with others
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity under your account

    • We reserve the right to suspend or terminate accounts that violate these Terms.

    4. Player Conduct

    While participating in the beta, you agree to:

  • Treat other players and staff with respect
  • Not exploit bugs, glitches, or unintended game mechanics
  • Report any bugs or exploits you discover
  • Not use automated tools, bots, or scripts
  • Not harass, threaten, or abuse other players
  • Follow any additional rules or guidelines we publish

    • Violation of these conduct rules may result in immediate account termination.

    5. Beta Confidentiality & Non-Disclosure Agreement (NDA)

    This section constitutes a Non-Disclosure Agreement (NDA) between you and the Tomb of the Infinite development team.

    During the beta period, you may have access to confidential and proprietary information, including but not limited to:

  • Game mechanics, systems, and features not publicly announced
  • Story content, lore, and narrative elements
  • User interface designs and visual assets
  • Internal communications from the development team
  • Other players' feedback and discussions within beta channels

    • All such information is considered "Confidential Information." You agree to:

  • Not disclose any Confidential Information to any person or entity outside of the authorized beta testing group
  • Not record, screenshot, or capture game content for public distribution without explicit written permission
  • Not stream, broadcast, or create public content featuring the Game without explicit written permission
  • Not discuss game details on public forums, social media, or any public platform
  • Maintain confidentiality even after the beta period ends or your access is revoked, until we publicly release the information or provide written permission

    • Exceptions: This NDA does not restrict you from:

  • Reporting bugs or feedback through our official channels
  • Discussing the existence of the Game in general terms (e.g., "I am participating in a beta test") without revealing specific details
  • Disclosing information as required by law

    • Breach: Violation of this NDA may result in:

  • Immediate termination of your beta access
  • Legal action to protect our intellectual property
  • Claims for damages resulting from unauthorized disclosure

    • 6. Feedback & Suggestions

    Any feedback, suggestions, bug reports, or ideas you provide regarding the Game ("Feedback") shall become our exclusive property. You agree that:

  • We may use, modify, and implement Feedback without compensation to you
  • You waive any rights or claims related to Feedback you provide
  • Feedback does not create any confidential relationship or obligation on our part toward you

    • We genuinely value your input and will credit beta testers appropriately in final release materials, though the form and manner of such credit is at our sole discretion.

    7. Player Content

    Any content you create within the Game, including but not limited to character names, descriptions, and in-game communications ("Player Content"), is subject to the following:

  • You retain ownership of original creative elements in your Player Content
  • You grant us a non-exclusive, worldwide, royalty-free license to use, display, and modify Player Content as necessary for Game operation
  • Player Content must not violate any third-party rights
  • We reserve the right to remove Player Content that violates these Terms

    • 8. Privacy

    We collect and process personal data as necessary to operate the Game. During the beta period:

  • We collect your email address and display name for account management
  • We log game activity for debugging and improvement purposes
  • We do not sell your personal data to third parties
  • We may use aggregated, anonymized data for analytics

    • A comprehensive Privacy Policy will be published prior to public release.

    9. No Warranty

    THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE." AS A BETA PRODUCT:

  • We make no guarantees about uptime, stability, or data persistence
  • Game progress, characters, or items may be reset or lost
  • Features may change, be removed, or malfunction
  • The Game may be discontinued at any time

    • TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Our total liability to you shall not exceed the amount you paid to access the Game (which during beta is zero)
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any loss of data, progress, or game content
  • This limitation applies regardless of the legal theory under which liability is asserted

    • 11. Changes to Terms

    We may modify these Terms at any time. If we make material changes:

  • We will notify you through the Game or via email
  • Continued use after notification constitutes acceptance
  • If you disagree with changes, your remedy is to stop using the Game

    • 12. Termination

    Either party may terminate this agreement at any time:

  • You may terminate by ceasing to use the Game and requesting account deletion
  • We may terminate your access for any reason, including but not limited to Terms violations

    • Upon termination, the confidentiality obligations in Section 5 survive indefinitely or until the information becomes publicly available through authorized channels.

    13. Governing Law

    These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Game shall be resolved through good-faith negotiation before pursuing formal legal remedies.
